解读医疗设备融资租赁监管新规

<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">2016年3月11日，国务院办公厅印发《关于促进医药产业健康发展的指导意见》（以下简称“《指导意见》”），就促进医药产业健康发展提出了若干新政策。其中，《指导意见》明确提出：“探索医疗器械生产企业与金融租赁公司、融资租赁公司合作，为各类所有制医疗机构提供分期付款采购大型医疗设备的服务。”对于医疗设备融资租赁行业而言，这无疑是一个利好消息。<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">近年来，随着医疗改革的深入和医疗需求的增加，各医疗机构购买和更新设备（尤其是大型设备）的需求持续增长，使得医疗设备融资租赁市场迎来高速增长期。但同时，由于医疗设备的特殊性，医疗设备融资租赁的出租人和承租人均受到比普通设备融资租赁更为严格的监管，在一定程度上制约了医疗设备融资租赁行业的发展。具体而言，金融租赁公司/融资租赁公司（以下简称“租赁公司”）开展医疗设备融资租赁业务除受到银监会/商务部的监管外，还受限于以下两方面的监管要求：<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">对租赁公司的资质要求 <p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">根据《医疗器械监督管理条例》（国务院令第650号）（以下简称“《条例》”）的规定，从事第二类医疗器械经营的，经营企业应向所在地设区的市级人民政府食品药品监督管理部门备案并提交其符合《条例》规定条件的证明资料；从事第三类医疗器械经营的，经营企业应当向所在地设区的市级人民政府食品药品监督管理部门申请经营许可并提交其符合《条例》规定条件的证明资料，医疗器械经营许可证有效期为5年。<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">根据国家食品药品监督管理局《关于融资租赁医疗器械监管问题的答复意见》（国食药监市[2005]250号）（以下简称“《答复意见》”），租赁公司开展融资租赁医疗器械是经营行为，应当按照《条例》的规定办理《医疗器械经营企业许可证》。此外，融资租赁发展最集中的两个地区——上海市和天津市也先后出台相应的医疗器械融资租赁监管规定，强调融资租赁企业需取得《医疗器械经营企业许可证》，同时对融资租赁企业的设施设备条件和质量管理提出了进一步要求。<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">在现行法律规章下，租赁公司从事相关医疗设备经营活动的，应根据《条例》和相关部门和地方规范性文件的要求办理备案或取得《医疗器械经营企业许可证》。对于违反规定的，食品药品监督管理部门有权依《条例》规定对违规的租赁公司进行处罚（包括但不限于没收违法所得、没收违法生产经营的医疗器械等等）。<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">对医疗机构采购医疗器械的控制 <p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">根据《大型医用设备配置与使用管理办法》（以下简称“《管理办法》”），对于列入国务院卫生行政部门管理品目的医用设备，以及尚未列入管理品目、省级区域内首次配置的整套单价在500万元人民币以上的医用设备，其管理实行配置规划和配置证制度，医疗机构（包括中华人民共和国境内的各级各类性质的医疗机构）获得《大型医用设备配置许可证》后方可购置大型医用设备。<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">针对各级政府、行业和国有企业举办的所有非营利性医疗机构采购医疗设备的事宜，《卫生部关于进一步加强医疗器械集中采购管理的通知》（卫规财[2007]208号）（以下简称“《通知》”）明确规定，所有非营利性医疗机构均应参加医疗器械集中采购，大型医用设备应取得配置许可证方可列入集中采购计划。此外，《通知》还明确规定要对医疗机构利用贷款、融资、集资等形式负债购置大型医用设备的行为进行严格控制。<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">1、值得注意的是，2015年3月24日，天津市市场和质量监督管理委员会发布《天津市医疗器械经营许可和备案管理的规定》（征求意见稿），其中亦明确从事医疗器械融资租赁应具有融资租赁资质，并且其经营范围仅限于融资租赁大型医用设备。<p style="margin-top: 5px; max-width: 100%; min-height: 1em; white-space: normal; color: rgb(62, 62, 62); font-family: sans-serif; line-height: 1.75em; margin-bottom: 10px; box-sizing: border-box !important; word-wrap: break-word !important; background-color: rgb(255, 255, 255);">2、参见《最高人民法院关于审理融资租赁合同纠纷案件适用法律问题的解释》第三条以及最高人民法院就该司法解释答记者问的相关内容。<hr style="white-space: normal; line-height: 25.6px;" /> ID: 最具人气的医疗器械维修新媒体平台分享医疗器械前沿动态、医疗器械维修经验        加群主微信 shanying916 与更多行业从业人员互动交流<img data-s="300,640" data-type="jpeg" src="http://mmbiz.qpic.cn/mmbiz/A1DicCH9Vl6MoypciaNOibiaxmVLk8eA6ibKL14uWjKsZwrWboQYKTfXqPicXycwL1icfia1pAG0VzlTX3MRR4FPV0ZtZA/0?wx_fmt=jpeg" data-ratio="1.0136054421768708" data-w="147" style="float: none;" />
