<p>医药网3月15日讯 3?15前夕，安徽省药监局公布了该省“2016十大食品药品案件”，其中医疗器械案件有1起。</p><p> </p><p> 合肥瑞诚<strong><span style="color: rgb(0, 153, 102);">医药</span></strong>有限公司经营未经注册的体外诊断试剂。在案件调查过程中，该公司还提供虚假证据。被依法没收违法所得，并处货值金额17倍罚款，共278.7万余元。</p><p> </p><p> 此外，六安市药监局发布2016年度违法案例，较为典型的也有2起使用无证<strong><span style="color: rgb(0, 153, 102);">医疗器械</span></strong>案。</p><p> </p><p> 1、六安市人民<strong><span style="color: rgb(0, 153, 102);">医院</span></strong>普儿科使用未依法注册的医疗器械“肺功能测试系统”（型号：PowerCube-Body，生产厂商：Ganshorn Medizin-Electronic GmbH）。购进价格是338000元。收费标准是90元/人次，共计收费金额109080元，违法所得109080元。</p><p> </p><p> 该医院被罚：没收违法使用的产品和违法所得109080元；处违法所得109080元三倍罚款327240元，合计罚没款为436320元。</p><p> </p><p> 2、六安市人民医院使用未依法注册的医疗器械“结蛋白抗体试剂”（批号：150411055A）等13种试剂。试剂瓶上明确标注“仅供研究、不用于临床诊断”，该院病理科使用上述试剂用于临床诊断并出报告。</p><p> </p><p> 该院被罚：没收违法使用的13种试剂；罚款5万元。</p><p> </p><p> 因为使用无证医疗器械这一个行为，六安市人民医院在2016年被罚了近50万元。</p><p> </p><p> 不过，这并不是最多的。在河北省药监局今年初公布的该省2016年度十大违法典型案件中，临漳县妇幼保健院使用的“GE”牌Voluson E6超声诊断仪，被药监部门认定为未经注册的医疗器械，作出没收产品并罚款1700多万元的行政处罚。</p><p> </p><p> 山西省药监局公布的2016年打击侵权假冒八大典型案例，与无证医疗器械有关的就占了2起。晋中市4家医疗机构使用未取得注册证书的假冒全自动生化分析仪系被查，长治市13家<strong><span style="color: rgb(0, 153, 102);">企业</span></strong>经营假冒一次性无菌注射针被罚近75万元。</p><p> </p><p> 类似案例还有很多。在与医疗器械相关的违反案件中，无证、假冒医疗器械案件总是最多的。</p><p> </p><p><strong> 今年药监重点整治无证医疗器械</strong></p><p> </p><p> 今年2月27日，药监总局局长毕井泉在国新办发布会上表示，去年，各级药监部门重拳打击<strong><span style="color: rgb(0, 153, 102);">药品</span></strong>医疗器械制假售假违法犯罪，但食药安全形势依然复杂严峻。2017年，要严字当头、重典治乱，严打药品安全领域的制假售假违法犯罪行为，集中力量查办大案要案。</p><p> </p><p> 在此前的2017年全国医疗器械监督管理工作会议上，药监总局副局长焦红也强调，今年全国医械监管重点工作包括“重点整治制假售假、虚假宣传、夸大功效、翻新再售等违法违规行为”。</p><p> </p><p> 而在多个省份已经出台的2017年度监管工作要点中，无证、假冒医疗器械的整治也被着重提出。</p><p> </p><p> 福建省药监局要求在8月31日金砖会晤开幕前完成全省医械风险排查。流通环节有“四个严查”，其中之一就是查经营未取得医疗器械注册证或备案凭证医疗器械的行为。使用环节有“三查三防”，其中之一也是查采购和验收，防无证产品流入使用单位。此外，还有“三个专项整治”，其中之一是无证生产经营行为专项整治。</p><p> </p><p> 四川省药监局要继续组织开展专项整治，对突出问题开展整治，重点是打击无证生产经营、生产仿冒品牌和无证产品、销售使用无证产品和翻新产品、篡改说明书标签标识等不法行为；要保质保量完成总局部署的打击网络医疗器械经营违法行为，继续与卫计委等部门联合开展打击经营使用无证医疗器械专项行动，重点整治使用无证大型设备和耗材等违法行为。该省的整治重点，无证医疗器械首当其冲。</p><p> </p><p> 内蒙古区局称，也将按照总局的部署开展网络医疗器械经营违法行为和无证经营医疗器械专项检查，重点整治网络销售隐形眼镜、避孕套等网络销量大的产品，以及销售假劣制氧机等违法违规行为，以及使用无证大型医疗设备和耗材等违法行为。与四川省一样，无证医疗器械是专项整治的重中之重。</p><p><br /></p><p><br /></p><p style="white-space: normal;"><span style="color: rgb(62, 62, 62);
