广东：第二类医械优先审批！时限缩减40%以上

医药网1月6日讯　2016年12月30日，广东省食药监局发布了关于印发《广东省第二类医疗器械优先审批程序（试行）》的通知（粤食药监办许〔2016〕579号）（以下简称《通知》）。 　　《通知》指出，发布该通知文件，是为了保障广东省医疗器械临床使用需求，满足公众用械需求，推动广东省医疗器械产业健康发展。 　　审批程序文件强调，对符合相关条件的该省辖区内第二类医疗器械首次注册的申请实施优先审批。并且，对于优先审批的项目，按照接收时间单独排序，优先办理，技术审查、检验时限分别在法定要求缩减20%以上，行政审批时限在法定要求缩减40%以上。 　　该审批程序已经自2017年1月1日起开始施行。 　　《广东省第二类医疗器械优先审批程序（试行）》的施行，标志着广东省在促进医疗器械审评审批制度改革的征程上又迈进了一大步！也正由此，广东医械人将在以后的医械行政审批等方面享受到更多福利！ 　　以下为《通知》及审批程序全文，供大家参考：关于印发《广东省第二类医疗器械优先审批程序（试行）》的通知 　　各地级以上市食品药品监督管理局、省局审评认证中心、省医疗器械质量监督检验所： 　　为了保障广东省医疗器械临床使用需求，满足公众用械需求，推动我省医疗器械产业健康发展，根据《医疗器械监督管理条例》（国务院令第650号）、《国务院关于改革药品医疗器械审评审批制度的意见》（国发〔2015〕44号）和《总局关于发布医疗器械优先审批程序的公告》（2016年第168号）等有关规定，我局组织制定了《广东省第二类医疗器械优先审批程序（试行）》，现印发给你们，请遵照执行。 　　附件：广东省第二类医疗器械优先审批程序（试行） 　　广东省食品药品监督管理局办公室 　　 2016年12月21日广东省第二类医疗器械优先审批程序（试行） 　　第一条为了保障广东省医疗器械临床使用需求，满足公众用械需求，推动我省医疗器械产业健康发展，根据《医疗器械监督管理条例》（国务院令第650号）、《国务院关于改革药品医疗器械审评审批制度的意见》（国发〔2015〕44号）和《总局关于发布医疗器械优先审批程序的公告》（2016年第168号）等有关规定，制定本程序。 　　第二条省食品药品监督管理局（以下简称省局）对符合下列条件之一的本省辖区内第二类医疗器械首次注册的申请实施优先审批： 　　（一）临床急需且在本省尚无同品种产品获准注册的医疗器械，或虽在省内已有同类产品上市，但产品供应不能满足突发公共卫生事件应急处理需要； 　　（二）诊断或治疗罕见病、恶性肿瘤，且具有明显临床优势的医疗器械； 　　（三）诊断或治疗老年人、儿童特有和多发疾病，且目前尚无有效诊断或治疗手段的医疗器械； 　　（四）列入国家、广东省科技重大专项或国家、广东省重点研发计划的医疗器械； 　　（五）广东省战略性新兴产业骨干企业、广东省直通车服务重点企业等广东省重点扶持的医疗器械生产企业申请注册的医疗器械； 　　（六）上一年度被省局评为质量信用A类，且本年度不在生产整改或涉案处理期间，未有医疗器械质量公告不合格的医疗器械生产企业； 　　（七）其他应当优先审批的医疗器械。 　　第三条对于符合本程序第二条第（一）、（二）、（三）、（四）、（五）、（六）项情形的，申请人应当在提交医疗器械注册申请时一并提交优先审批申请表（见附件1）。 　　对于本程序第二条第（四）、（五）项情形的医疗器械优先审批申请，申请人还应当提交相关证明文件。 　　第四条省局医疗器械注册申请受理部门对优先审批申请材料进行形式审查，对优先审批申请材料齐全且予以受理的注册申请项目，注明优先审批申请，转交省局进行审核。 　　第五条对于本程序第二条第（四）、（五）、（六）项情形的医疗器械优先审批申请，省局自收到申请之日起5个工作日内进行审核，符合优先审批情形的，拟定予以优先审批。 　　对于本程序第二条第（一）、（二）、（三）项情形的医疗器械优先审批申请以及其他应当优先审批的医疗器械，省局组织专家论证审核，出具审核意见。经专家论证需要优先审批的，拟定予以优先审批。 　　第六条省局将拟定优先审批项目的申请人、产品名称、受理号在其网站上予以公示，公示时间应当不少于5个工作日。公示期内无异议的，即优先进入审评程序，由省局书面通知申请人审核结果（格式见附件2）。 　　第七条对公示项目有异议的，应当在公示期内向省局提交书面意见并说明理由（异议表见附件3）。省局应当在收到异议起10个工作日内，对相关意见进行研究，并将研究意见告知申请人和提出异议方。 　　第八条省局经审核不予优先审批的，将不予优先审批的意见和原因告知申请人，并按常规审批程序办理。 　　第九条对于优先审批的项目，按照接收时间单独排序，优先办理，技术审查、检验时限分别在法定要求缩减20%以上，行政审批时限在法定要求缩减40%以上。 　　第十条对于优先审批的项目，省局审评认证中心在技术审评过程中，应当按照相关规定积极与申请人进行沟通交流，必要时，可以安排专项交流。 　　第十一条已经按照《医疗器械应急审批程序》（国食药监械〔2009〕565号）、《创新医疗器械特别审批程序（试行）》（食药监械管〔2014〕13号）、《广东省第二类创新医疗器械特别审批程序（试行）》（食药监办械注〔2015〕511号）进行审批的注册申请项目，不执行本程序。 　　第十二条本程序自2017年1月1日起施行。 <p style="font-size: 16px;
